Black becomes white – Balearics retroactively license illegal residential buildings

The project for the reformation of the law on the use of land, the “Ley de ordenación y el uso del suelo (LOUS)” concerns itself with the legalisation of illegally erected residential buildings on land designated as agricultural. The Balearic government has now officially approved this project. Illegally erected residential buildings on agricultural land may now be retroactively licensed under certain conditions. Residential buildings and facilities used for agricultural purposes that were built without a licence more than 8 years ago may now be retroactively licensed. The prerequisite for this is that the land is not in an area designated as a nature reserve, and that no criminal charges or disciplinary proceedings exist. Changes to Spain’s Residential Property Ownership Act

Spain’s Residential Property Ownership Act applies to all freehold apartments, business premises, garages, terrace houses and residential complexes that have commonly owned property (e.g. green areas, stairways, etc.). The Act, which dates back to the 1960s, has now been updated with Reform Act 8/2013, particularly with regard to social and energy efficiency-related requirements. This now makes it far easier to obtain licences for the retrofitting of lifts and barrier-free access for people with disabilities and residents aged over 70. Real estate sales figures continue to rise in the Balearics

The Spanish statistics office, INE, reports that 623 properties (excl. social housing) were sold in the Balearics in July 2013. This represents a year-on-year increase of 9%. Impressive property in privileged situation close to Llucmajor In total, notaries in Majorca, Ibiza and Minorca recorded 4,727 sales transactions in the private housing market during the first seven months of the year. This confirms the previous months’ increases: in total from January to July, 8.4% more properties were sold compared with last year. This means that the Mediterranean islands are significantly above the Spanish average – an increase of 4.9% during the same period. Energy certificate mandatory The European energy label showing efficiency ratings from Green A (low energy requirement) to Dark Red G (high energy consumption) which you will have seen on household appliances, is now going to be mandatory for property owners wishing to sell or let their properties. With royal decree 235/2013 of 5th April, the Spanish government has extended the scope of a provision that previously applied only to new-builds, so that it now covers existing properties as well.
