Black becomes white – Balearics retroactively license illegal residential buildings

The project for the reformation of the law on the use of land, the “Ley de ordenación y el uso del suelo (LOUS)” concerns itself with the legalisation of illegally erected residential buildings on land designated as agricultural. The Balearic government has now officially approved this project. Illegally erected residential buildings on agricultural land may now be retroactively licensed under certain conditions. Residential buildings and facilities used for agricultural purposes that were built without a licence more than 8 years ago may now be retroactively licensed. The prerequisite for this is that the land is not in an area designated as a nature reserve, and that no criminal charges or disciplinary proceedings exist. Spanish residency law for foreign property buyers takes effect

The legislation, popularly known as the “Golden Visa Act”, gives foreign investors the right to free movement and residence within the EU On 30th September 2013 the Spanish legal gazette – the Boletin Official del Estado (BOE) – announced the eagerly anticipated new Act for foreign investors. As of now, non-EU citizens who make a minimum investment of € 500,000 in Spain, for example in real estate, may apply for a so-called investor visa that is valid for one year. During this period, the investor is not required to meet any minimum stay requirements in Spain – he can retain his main residence, and thus also his tax domicile, in his home country. Real estate sales figures continue to rise in the Balearics

The Spanish statistics office, INE, reports that 623 properties (excl. social housing) were sold in the Balearics in July 2013. This represents a year-on-year increase of 9%. Impressive property in privileged situation close to Llucmajor In total, notaries in Majorca, Ibiza and Minorca recorded 4,727 sales transactions in the private housing market during the first seven months of the year. This confirms the previous months’ increases: in total from January to July, 8.4% more properties were sold compared with last year. This means that the Mediterranean islands are significantly above the Spanish average – an increase of 4.9% during the same period.
